Terms of Service

Pitloon ("we", "us", "our") provides this application and related services subject to the following Terms of Service ("Terms"). By creating an account or logging in, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

These Terms are a legal agreement between you ("User", "you") and Pitloon governing your use of the Pitloon application (the "App"). By registering for an account, logging in, or otherwise accessing or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

We reserve the right to update these Terms at any time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

2. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and consented to these Terms.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

  • - Provide accurate, current, and complete information during registration
  • - Keep your account information up to date
  • - Notify us immediately of any unauthorised use of your account
  • - Not share your account credentials with any third party

We reserve the right to terminate or suspend accounts at our discretion, including for violations of these Terms.

4. User-Generated Content

The App allows you to create and share content including photos, text, and other materials ("User Content"). User Content may be visible to other registered users of the App. By posting User Content, you grant us a non-exclusive, worldwide, royalty-free licence to display and distribute your content within the App. You represent and warrant that you own or have all necessary rights to post your content, and that your content does not violate any third-party rights or applicable laws.

5. Zero Tolerance for Objectionable Content

Pitloon enforces a strict zero-tolerance policy for objectionable content and abusive users. You must not post, share, upload, or otherwise make available any content that:

  • - Is abusive, harassing, threatening, intimidating, or bullying toward any person
  • - Is hateful or discriminatory based on race, ethnicity, religion, gender, sexual orientation, disability, or any other characteristic
  • - Is sexually explicit, pornographic, or otherwise inappropriate
  • - Depicts or promotes self-harm, violence, or illegal activity
  • - Contains private information of others without their explicit consent
  • - Is spam, deliberately deceptive, or misleading
  • - Infringes any intellectual property or other rights
  • - Violates any applicable law or regulation

Violations will result in immediate content removal. Users who post objectionable content will be subject to account suspension or permanent termination. We commit to reviewing and acting on all reports within 24 hours of receipt.

6. Reporting Objectionable Content

If you encounter content that you believe violates these Terms, you must use the in-app reporting feature to flag it. When a report is submitted:

  • - We are immediately notified of the report and the nature of the objectionable content
  • - We will investigate and take appropriate action, including content removal and account termination, within 24 hours

Submitting a false or malicious report is itself a violation of these Terms and may result in account termination.

7. Blocking Abusive Users

You may block any user at any time using the in-app blocking feature. When you block a user:

  • - Their content is immediately removed from your feed and is no longer visible to you
  • - They are prevented from interacting with your content or profile
  • - We are automatically notified so we can review the blocked user's behaviour and content
  • - We will investigate and may take further action, including suspension or permanent account termination

8. Enforcement and Account Termination

We reserve the right, at our sole discretion, to remove any User Content that violates these Terms, and to suspend or permanently terminate accounts of users who post objectionable content. Users who are terminated for policy violations are prohibited from creating new accounts. We may also refer illegal content or behaviour to appropriate law enforcement authorities.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Intellectual Property

All content, features, and functionality of the App (excluding User Content) are owned by Pitloon and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App solely for your personal, non-commercial purposes in accordance with these Terms.

11. Disclaimers and Limitation of Liability

The App is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. To the fullest extent permitted by applicable law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the App or its content, or from content posted by other users. Nothing in these Terms limits any rights you may have under the Australian Consumer Law.

12. Governing Law

These Terms are governed by the laws of Australia. Any disputes arising under or in connection with these Terms shall be subject to the jurisdiction of the courts of Australia.
